These terms and conditions govern your use of the Seth Dive website (sethdive.com) and the diving, snorkeling, and related services provided by Seth Dive (“we,” “us,” or “our”). By using our website or booking a service, you agree to these terms.

1. Services

Seth Dive offers private and semi-private guided diving, snorkeling, and scuba certification tours in Mexico’s Riviera Maya, including cenote diving, ocean reef diving, cenote snorkeling, Discover Scuba experiences, and PADI certification courses.

All services include the equipment, guide, transportation (free hotel pickup from Cancun to Tulum), and amenities specified on the relevant service page. Specific inclusions may vary by tour and are confirmed at the time of booking.

2. Booking & Payment

• Bookings are made through WhatsApp, email, or our contact form. A booking is confirmed once we send you a written confirmation.
• Prices listed on our website are in US Dollars (USD) unless otherwise stated.
• A deposit of $100 USD is required to secure your booking.
• The remaining balance is due on the day of the trip, unless other arrangements are made.
• We accept cash, credit card, and PayPal.

3. Cancellation & Refunds

In order to book tours we take a deposit of $100 USD. If canceling more than 48 hours in advance we usually can refund the deposit, however if we have had to turn away groups because we are holding your day, your deposit will be kept to pay the guides and admin fees.

• By us (weather/safety): If we cancel a tour due to unsafe weather or conditions, you will receive a full refund or the option to reschedule at no additional cost.
• No-shows: If you do not show up for a confirmed tour without prior notice, no refund will be provided.

4. Health & Medical Requirements

Scuba diving and snorkeling are physical activities that carry inherent risks. By booking a dive or snorkeling tour with us, you represent that:

• You are in good physical health and fit to participate in the activity you have booked.
• You will disclose any medical conditions, medications, or physical limitations that may affect your safety underwater, including but not limited to heart conditions, respiratory issues, epilepsy, diabetes, pregnancy, or recent surgeries.
• You understand that you may be required to complete a medical questionnaire and/or obtain a physician’s clearance before participating in scuba diving activities, as required by PADI standards.
• You acknowledge that we reserve the right to refuse service if we believe participation could pose a safety risk to you or others.

5. Assumption of Risk

Scuba diving, cenote diving, snorkeling, and related water activities involve inherent risks, including but not limited to: decompression illness, drowning, marine life encounters, equipment malfunction, and injuries from underwater environments.

By participating in our activities, you acknowledge and voluntarily assume these risks. You agree that you are participating of your own free will and that you have been informed of the nature of the activities and their associated risks.

Before diving, all participants will be asked to sign a standard liability release and assumption of risk agreement, in accordance with PADI and industry standards.

6. Minimum Age

• Snorkeling: Open to all ages. Children under 12 must be accompanied by a parent or guardian.
• Discover Scuba Diving: Minimum age of 10 years, as per PADI standards.
• Certified Diving: Minimum age of 10 years for Junior Open Water; 15 years for full Open Water certification.

Minors must have written consent from a parent or legal guardian to participate in any diving activity.

7. Our Responsibilities

We commit to:

• Providing qualified, experienced dive guides for all tours
• Maintaining all dive equipment in safe, working condition
• Following PADI standards and Mexican regulatory guidelines
• Prioritizing the safety of all participants at all times
• Providing accurate descriptions of our services and pricing

8. Limitation of Liability

To the maximum extent permitted by law, Seth Dive shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services or website, including loss of enjoyment, personal injury beyond the scope of our control, or damages resulting from circumstances beyond our reasonable control (force majeure).

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

9. Intellectual Property

All content on this website — including text, photographs, videos, logos, and design — is the property of Seth Dive or used with permission. You may not reproduce, distribute, or use our content without written permission.

Photos and videos taken during your tour may be shared on our website and social media for promotional purposes. If you prefer not to be featured, please let your guide know before or during the tour.

10. Website Use

Our website is provided for informational purposes and to facilitate communication about our services. We make reasonable efforts to keep content accurate and up to date, but we do not guarantee that all information is complete or current at all times.

11. Governing Law

These terms are governed by the laws of Mexico. Any disputes arising from these terms or our services shall be subject to the jurisdiction of the courts of Quintana Roo, Mexico.

As a consumer, you may also file a complaint with PROFECO (Procuraduría Federal del Consumidor), Mexico’s federal consumer protection agency.

12. Changes to These Terms

We may update these terms from time to time. Changes will be posted on this page with an updated date. Continued use of our website or services after changes are posted constitutes acceptance of the revised terms.
